The Texas Court of Criminal Appeals has stopped the scheduled execution of Bobby Wayne Woods due to claims that the 42 year old man is mentally retarded. Woods was scheduled to be executed in Huntsville today for the 1997 death of his ex-girlfriend's 11 year old daughter.

Woods claimed that he wasn't responsible for the young girl's death and blamed it on his cousin who ended up killing suicide. Woods was to be the second prisoner in the State of Texas this week to have been executed. Two more men are scheduled to be executed next week.

The appeal that Woods' lawyers filed cited IQ tests and records that showed Woods received failing grades in most of his special education classes when he was going to school. Woods has been proven to have severe deficiencies in reading and writing skills, understanding the concept of punishment and understanding that actions have consequences.

However, Woods made a statement to police at one time, saying that he had taken drugs before he went to his former girlfriend's house and he admitted to the abduction. DNA found on the murder weapon was traced back to Woods.

The fact that Woods' execution has been delayed brings quite a bit of media attention to a very hotly debated topic in today's world. Texas currently leads the nation in executions of inmates, with 13 already this year.

I was involved in the search for Sarah.
And my family is buried in the graveyard where he left Cody for dead before he took the girl to the other side of town to rape her again & slit her throat!

There is no way you could ever convince me he didn't know the consequences of his behavior!

- Your murder rate are five times higher than the rest of the western world, and NONE of these countries got capital punishment.... Figure that one out. How come? Anyone?

If you have so much faith in your criminal justice system, why does it take 10-11 years for you to carry out the sentence? Also, why is the cause of death of executed inmates stated as 'Homicide'? Surely this means murder?

With more prisoners convicted of murder than anywhere else, your death penalty is not a deterrent. Most of the ones on death row are ready to accept their fate when the time comes, so surely that proves that your harsh prison regime is a better option. Make them suffer for their crimes, remind them every day of what they have done and why they are there, dont go the revenge route. That makes you just as bad as the convicted.

Absolutely agree... Execution is in no way a deterrent to Murder, that is proven.

The concept of Execution is medievil outdated and puts the US on the same level as Asian Countries, a level which they constantly maintain they are above.

I was 12 years old and can remember all the news people at my school and the helicopters all around for, I believe 3 days to find Sarah. I wasn't aloud to go any where by myself for a long time after that. This man should die for what he did and he knows what he did they have prove that before when he claimed he is retarted. Why keep him alive? We are just paying for a murderer to stay alive, to eat, to sleep, Why?? Sarah was buried on her 12th birthday people kill this man and let everyone that knew Sarah breath easier.

I am upset about those stupid comments from those European anti death penalty people which share more sympathy for the killer than for the victims!

All I can say is, that I hope that one of their loved ones or even kid is being raped and killed by some sick bastard! I wonder if they still will carry sympathy for the killer! I am from Germany, been to prison there too and I just hope that they bring back the death penalty to Germany again, so those killer bastards retarded or not, get the penalty they deserve!!!

Woods is a MONSTER and should have been executed as scheduled for the brutal murder he DID commit. His so-called low IQ did not keep him from carrying out his day of terror on 2 innocent children and then planning his defense of lies about his cousin..... The death penalty and carrying out of it, is not for revenge. To those who oppose execution....
It is about punishment for crimes comitted. It's about the destruction brought on by those who comitt murder. Their victims did not get a reprieve, their families will never get to see their loved one again, the pain they suffer will be with them for the rest of their own lives. The
crimes comitted are at the very least brutal, cruel, horrific, this begs for punishment. I have no empathy for someone who kills another person in such a fit of unbridled rage, hate, anger, stupidity, or because they are out of their mind on drugs, or just because they have nothing else to do. They should have to answer for what they do, with their own lives. They took lives and futures away from others. They ran amok and did the unthinkable. The unimaginable. The horrific.
And then try to get out of it.
It is reprehensible. I DO believe they need to be punished. Living in a small cell, eating, breathing, reading, plotting out their next appeal is not my idea of punishment for them.

Good for Texas!! In Canada a guy just came up for parole after 25 years. He shot 4 adults then took the 11 and 13 year old girls with him where he raped them for a week before slitting their throats. This man should have been dead 25 years ago...but in Canada many don't believe in Capital punishment and that's too bad.

After working 25 years as a firefighter/paramedic I've dealt with a lot of bad things. For the people against the death penalty you should try to understand that there are just some bad people out there. They are evil and can never be rehabilitated. Why not put the millions of $$ spent on keeping them alive into crime prevention.

Texas has it right. Get rid of the evil people.

I feel we should be able to vote for who lives and who dies...I personally cannot afford to feed the people on welfare, the illegal idiots who come here thinking they should get everything for free, and these dirty criminals!! It’s hard enough trying to feed my own family why should I have to pay for these RETARDED IDIOTS to have a roof over their head, 3 meals a day, TV, books, etc. If you commit a crime you should be punished for it...if you do not contribute successfully to society then you should be removed from society. Period and AMEN!!!
