Dallas Defective Products Lawyer: Defective Products Can Cause Serious Injury

If you’ve ever been injured when you were using a product, it is likely that it wasn’t your fault that you sustained those injuries. Products are constantly being created, manufactured and sold with defects and flaws in their design. It is sad that these defects can result in injury and even death. Anyone who is injured while using a product may be able to sue the manufacturer or store for monetary damages.

When a store (or anyone responsible for the product) is found to be at fault in a defective products (or products liability) case, the court may order them to compensate the victim for any injuries caused by the defective product. The court may also choose to award “punitive” damages, which are designed to punish the parties responsible for the defective products. Experienced product liability attorneys will be able to explain how the laws work and will strive to get you the compensation you deserve.

Many products liability claims revolve around defective cars. With so many different components, there are many things that can go wrong. Brakes can go out, airbags may not deploy correctly or the engine might have serious defects. But product liability claims may also be taken out against home appliances, medications or toys. Defective products are constantly being recalled by manufacturers, but sometimes it isn’t fast enough, and then people are injured or even killed.

If you’ve been injured by a defective product, contact us for a free evaluation by filling out the form to the left of this text. You may be eligible for compensation for your pain and suffering.

Originally posted at InjuryBoard by Jeff Rasansky

Cribs Recalled After Four Children Are Trapped

A recall has been issued for about 320,000 cribs, after four children became trapped. Apparently the wooden slats on the crib’s frames can break and children can get trapped in the remaining gap. The Consumer Product Safety Commission is aware of at least 42 incidents of broken slats and four where children were trapped.

These cribs were manufactured in Taiwan by Jardine Enterprises and sold by Kidsworld stores, Geoffrey stores, Toys “R” Us and Babies “R” Us. They were available nationwide between January 2002 and May 2008.

Originally posted at InjuryBoard by Jeff Rasansky

Polaris To Expand Recall of ATVs

Polaris Industries will be expanding its recall of
all-terrain vehicles. Apparently, some of these vehicles have defective control
modules that can overheat and cause fire and burn hazards to their riders.

The recall was originally announced in February of 2008 and
involves the Polaris ATVs with model years 2004. The defective ATVs were sold
under the market names Scrambler 500 and Sportsman 400, 500, or 6x6. The model
number is usually displayed by a decal on the body of the machine.

Consumers are advised to disconnect the negative battery
cable from the battery when the ATV is not in use. Consumers are told to
contact their local Polaris dealers to schedule free repairs. For more
information contact Polaris at www.polarisindustries.com

North Texas Toy-Maker Recalls Rock 'N Ride Rocker

A Southlake toy-maker just announced the recall of about 122,000 units of Rock 'N Ride plush rockers because the product could potentially injure young children. The company has received 35 reports of the rocker tipping over, with 10 such incidents resulting in injuries like bumps, bruised and lacerations. The culprint? A faulty plastic base that could make the rockers unstable.

The eight different recalled models of the rocker, made by Chinese manufacturer Tek Nek Toys International L.P., include the brown pony, pink pony, pink unicorn, deluxe pony, deluxe bull, lil' penguin, lil' propeller plane and Clifford big red rocker designs with date codes from July 26 through December 29, 2007 (printed on a sticker in the battery compartment). These rockers, sold at Wal-Mart, Toys 'R' Us, K-Mart, Target, Atwoods, and Pamida stores, as well as through the Internet, should be immediately removed from the reach of young children. Tek Nek Toys will provide a free replacement base upon contact. ( http://www.teknektoys.com )

There has been a slew of issues with dangerous and faulty toy products lately. If you or your child has been injured by a defective product, contact a lawyer with experience in product liability law to discuss your legal options.

Originally posted at InjuryBoard by RLF Staff

Toxic Chemical Used to Make Baby Formula Cans Under Review

Bisphenol-A is a toxic chemical used in the manufacturing process of baby formula cans. House Democrats are investigating whether bisphenol-A--known as BPA-- poses a risk to infants. BPA is a chemical used in polycarbonate plastic products, including baby bottles and metal can coatings, intended to protect the food inside from the metal in the can. According to the FDA BPA is legal and safe.

BPA has been used to package foods for over 50 years, but consumer advocates said last year that trace amounts that leak into food could be dangerous to babies. Concerns over BPA caused Canadian retailers to remove bottled water and other plastic containers containing BPA from store shelves In December 2007. The FDA is reviewing the safety of the chemical but said last November that it "sees no reason at this time to ban or otherwise restrict its use." In a letter to FDA, Michigan Democrats Dingell and Stupak asked commissioner Andrew von Eschenbach to explain how the agency determined BPA's safety. "At best, the scientific community has concerns about the safety of bisphenol A," said Stupak. "Our primary goal is to protect infants from a potentially harmful chemical."

An expert panel of researchers assembled by the National Institutes of Health said last August that the chemical's "impact on human health is a concern, and more research is clearly needed." Additional research is a good idea, according to a trade group for baby formula makers, but they stressed Thursday that regulators in the U.S. and Europe believe the amounts found in food products are not dangerous. "Parents using infant formula should not be alarmed because the bisphenol used in infant formulas and other food packaging exists in trace amounts," said Marisa Salcines, spokeswoman for the International Formula Council. "No change in infant feeding practices are necessary at this time."

Originally posted at InjuryBoard by RLF Staff

The U.S. Department of Agriculture's Food Safety and Inspection Service (FSIS) has issued a public health alert for nearly 15,000 pounds of ground beef products that may be contaminated with E. coli, produced by Texas American Food Service Corporation based in Fort Worth, Texas.

Local officials have received reports of someone who has attempted to sell ground beef to local businesses. The Texas health department said eight businesses, mostly restaurants have reported the issue, but it is not known if any other establishments have purchased the possibly tainted beef.

The health alert includes ground beef products with establishment number "EST. 13116" on the labels of consumer products and "EST. 13116" on bulk products.

The Dallas and U.S Department of Agriculture are increasing inspections to hopefully prevent mass illness in Dallas.

For more information on this subject, please refer to the section on Defective and Dangerous Products.

Originally posted at InjuryBoard by RLF Staff
